1. General Provisions

These Terms and Conditions ("Terms") govern your access to and use of the AI Image Generator (the "Service"). The Service is operated by ZAVRA LIMITED, with its registered office at Level 35, Two Pacific Place, No 88 Queensway, Hong Kong ("we", "us", "our").

By accessing and using the Service, you agree to comply with these Terms. If you do not agree, please refrain from using the Service. We reserve the right to modify these Terms at any time. Continued use of the Service constitutes acceptance of any updated Terms.

2. User Responsibilities

  • Users must provide accurate and complete information when registering or making purchases.
  • Users are responsible for maintaining the confidentiality and security of their account credentials.
  • The Service may not be used to generate, upload, or distribute content that violates applicable laws, infringes intellectual property rights, or promotes harmful, misleading, or unlawful material.
  • Users acknowledge that all images generated through the Service are created by artificial intelligence and may not always meet subjective expectations, stylistic preferences, or specific requirements.

3. Ordering & Delivery

  • You may access the AI Image Generator by using purchased credits. To place an order for credits through our website, you must first register an account on imagora.art.
  • Credits are not considered an asset, stored value, or electronic money. They are a limited means of exchange solely for accessing the AI Image Generator services provided through imagora.art. You may view your purchase history and current credit balance through your user account after logging in.
  • To purchase credits, please use the payment widget available on the pricing page and confirm that you have read and agreed to these Terms. You will be redirected to an external payment gateway to complete the transaction securely. Following successful payment confirmation, purchased credits will be credited to your account. Delivery is typically completed promptly but may take up to one (1) business day depending on technical or system availability.
  • If you do not receive your credits within one (1) business day after successful payment, or if your account is invalid or inaccessible, please contact customer support at support@imagora.art.
  • We reserve the right to cancel or reverse any order in cases of suspected fraud, technical errors, abuse, or violations of these Terms. Any refund issued in such cases will be processed in accordance with our refund rules.

Anti-Fraud Notice

We actively monitor transactions for fraudulent, abusive, or unauthorized activity. We reserve the right to suspend or terminate any account, order, or transaction that we reasonably believe violates these Terms or applicable laws. In such cases, access to purchased credits may be restricted or revoked, and refunds may be denied where permitted by law.

4. Payment & Refund Policy

  • All payments are processed securely through trusted third-party payment providers. We do not store or process your full payment card details.
  • Prices may change from time to time based on market conditions, service usage, or operational requirements.
  • Due to the digital nature of the Service and the immediate availability of credits after purchase, no cooling-off period applies. Once credits are successfully delivered, no refunds or reimbursements will be offered except where delivery has failed due to a technical error.
  • The delivery of credits depends on the proper functioning of third-party systems. In rare cases where a transaction is completed but credits are not delivered, the user may be eligible for a refund.
  • Credits that have been used, partially used, or exchanged for services are strictly non-refundable. Once any portion of purchased credits has been consumed, no refund will be issued for the used amount.
  • Refund requests must be submitted within 30 calendar days from the transaction date. Approved refunds will be issued minus applicable transaction fees and processing costs and will be returned using the original payment method and currency. All refunds are final, non-cancellable, and irreversible once processed. Approved refunds are typically completed within 7 business days but may take up to 30 calendar days in certain cases.
  • If you have not received an approved refund, please contact us with relevant transaction details, including order ID and payment information.
  • All purchases on imagora.art are one-time payments. We do not offer subscriptions, recurring billing, automatic renewals, or periodic charges. Charges occur only when a user manually initiates a purchase.

5. Intellectual Property Rights

  • Users retain rights to the AI-generated images they create through the Service, subject to applicable laws and any licensing restrictions.
  • By using the Service, users grant us a non-exclusive, royalty-free, worldwide license to use generated images for operational, analytical, and promotional purposes, unless the user explicitly opts out where such an option is available.
  • All underlying software, AI models, algorithms, and platform infrastructure remain the exclusive intellectual property of the Service provider.

6. Liability & Disclaimers

  • The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or suitable for any specific purpose.
  • To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or related to the use of, or inability to use, the Service.
  • Users assume full responsibility for the use of AI-generated content and for ensuring its compliance with applicable laws, regulations, and ethical standards.

7. Privacy & Data Protection

  • We process personal data in accordance with our Privacy Policy.
  • We implement reasonable technical and organizational measures to protect user data but cannot guarantee absolute security.
  • Users are encouraged to review the Privacy Policy for detailed information on data processing practices.

8. Governing Law & Dispute Resolution

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong, without regard to conflict of law principles.
  • Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiations or alternative dispute resolution, unless mandatory law requires otherwise.
